These Terms of Use ("Terms") govern your access to and use of the In-dependent Living mobile application (the "App") provided by Theory Solutions LLC ("we," "us," or "our"). By creating an account or using the App, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account. By using the App you represent that you meet this requirement and that the information you provide is accurate.

2. Not Medical Advice

The App is a tool to help organize medications, appointments, and daily activities. It does not provide medical advice, diagnosis, or treatment, and it is not a substitute for professional medical care or emergency services. Always consult a qualified healthcare provider for medical decisions, and in an emergency contact your local emergency services.

3. Subscriptions and Payments

Certain features require a paid subscription, processed through Apple's App Store. Payment is charged to your Apple ID at confirmation. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your Apple ID Account Settings.

Refunds are handled by Apple in accordance with the App Store policies. We do not directly process or issue refunds.

4. Accounts and Pairing

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. When you pair with a caregiver or family member, you authorize them to view the data shared through the App. You may unpair at any time within the App.

5. Acceptable Use

You agree not to:

Use the App for any unlawful purpose or in violation of these Terms.
Attempt to reverse engineer, decompile, or interfere with the App.
Upload content that is harmful, infringing, or violates the rights of others.
Use the App to provide emergency medical services to others as a substitute for professional care.

6. Reminders and Notifications

Push notifications, including medication and SOS alerts, depend on your device, network, and operating system settings. We do not guarantee delivery and you should not rely on the App as the sole means of receiving time-critical information.

7. Intellectual Property

The App, including its design, code, content, and trademarks, is owned by Theory Solutions LLC and protected by applicable laws. We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. Your Content

You retain ownership of the information you enter into the App. You grant us a limited license to store, process, and display your content as necessary to provide the App's features, including sharing with paired accounts you authorize.

9. Termination

You may stop using the App at any time and request account deletion. We may suspend or terminate access if you violate these Terms or if we discontinue the App. Subscription terms continue to be governed by Apple's policies.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEORY SOLUTIONS LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Theory Solutions LLC from any claims, damages, or expenses arising from your misuse of the App or violation of these Terms.

13. Apple-Specific Terms

These Terms are between you and Theory Solutions LLC, not Apple. Apple is not responsible for the App or its content. In the event the App fails to conform to any applicable warranty, you may notify Apple, which will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Governing Law

These Terms are governed by the laws of the United States and the State in which Theory Solutions LLC is organized, without regard to conflict-of-law principles. Disputes will be resolved in the courts of that jurisdiction, unless required otherwise by applicable law.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the App or by email. Continued use of the App after the changes take effect constitutes acceptance.
